These Terms and Conditions govern your use of any website, webstore, and/or mobile experience operated by 2Maro Media Inc. on behalf of recording artist Ali Caldwell (collectively, the “Site”). The Site is made available by 2Maro Media Inc. (“2Maro,” “we,” “us,” or “our”). By accessing or using the Site in any way, including browsing, making a purchase, creating an account, or submitting any content or information, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must not use the Site.
We may change these Terms and Conditions from time to time by posting an updated version on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of those changes. The Site may include the option to purchase physical and digital products, including merchandise, music, tickets, or other goods and services. Purchases made through the Site are also subject to our Shipping Policy and Refund & Return Policy, which are incorporated into these Terms and Conditions by reference.
As between you and us, 2Maro Media Inc. (on behalf of Ali Caldwell) owns all rights, title, and interest in and to the Site and all content and materials appearing on or made available through the Site. This includes, without limitation, all music, audio, video, photographs, artwork, graphics, text, logos, designs, software, code, data, and the overall look and feel and organization of the Site, as well as all copyrights, trademarks, and other intellectual property rights associated with them. Your use of the Site does not grant you any ownership rights in any content, code, data, or materials you access. You may view the Site and make a single copy for your own personal, non-commercial, internal use only. Any commercial use, reproduction, distribution, public performance, or exploitation of the Site or its content is strictly prohibited unless you have received prior written permission from us or the applicable rights holder.
All names, logos, service marks, and trade names appearing on the Site, including but not limited to “Ali Caldwell” and any related logos or branding, are trademarks or service marks of 2Maro Media Inc., Ali Caldwell, or their respective owners. You may not use any such marks in a way that is likely to cause confusion or in any manner that disparages or discredits the owner. Nothing on the Site should be interpreted as granting any license or right to use any trademark displayed on the Site without prior written permission.

Our collection and use of User Information is governed by our Privacy Policy. You are solely responsible for the accuracy and completeness of your User Information.

By enrolling in such a program, you agree to receive SMS and/or MMS messages at the mobile number you provide. Message frequency may vary, and your mobile carrier’s message and data rates may apply. You agree to notify us immediately of any unauthorized use of your account or other security breaches. We are not liable for any loss or damage arising from your failure to protect your login information.

By placing an order, you represent that you are at least the age of majority in your jurisdiction and authorized to use the payment method provided. IF YOU ARE DISSATISFIED WITH THE SITE, YOUR SOLE REMEDY IS TO STOP USING IT. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 2MARO MEDIA INC., ALI CALDWELL, OR THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PRODUCTS OR SERVICES PURCHASED THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE TOTAL AMOUNT, IF ANY, THAT YOU HAVE PAID TO US IN CONNECTION WITH YOUR USE OF THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These Terms and Conditions and any dispute arising out of or related to them shall be governed by the laws of the State of California, without regard to its conflict of law principles.
